resolve payments?

In the thread below I see people attributing this or that percentage of the fault to one of the operators. Do insurance companies pay according to some sort of "percentage fault" formula? Does the CG issue citations based upon a percent fault?

The fact that we are not all in agreement about the percentage of fault for the ferry collision says to me that either we need education or the rules are lacking in clarity or both. Which is it?
