If it is a Mac 26, it must be a very old one, it doesn't have the wrap around windows of the models from about 2000 on.
The pic below is supposedly from the incident... and it does clearly say MacGregor on the the port stern. Maybe it is an earlier 25.
What gets me is if this is a rental boat, how in the world did they allow 10 people on the thing. I had no idea there were such rental agencies in San Diego (that rent such boats). Most of the charter companies around rent fixed keel boats. Capri 22s, Victory yachts, Ensigns and larger Catalinas and the usual Beneteaus and Hunters.
Speculation on Sailing Anarchy is that it is a Mac 25D or C. (thanks for pointing me to that site Jon... I usually steer clear as it tends to be just a bunch of ranting)
The first stories of the day were stating it was a 35 foot boat...
