I don't get it, it's a dwelling, and should be treated as such.

So therefore it shouldn't be accepted as a boat at marina docks or an anchorage. The only hazy area to me are barges which this could fall into some category no doubt(they have navigation rules as well though). But as long as vessel rules are set for a marina or followed at an anchorage, it's still illegal.

He has a dwelling with no lot. The lots do exist I'm sure, and or docking situations that are legally permitted for this use, and will either be costly or in a location that has cheaper shoreside realestate. Then he simply has to deal with DEP regs to that will allow him the legal permits to occupy the house.

In the mean time, he's just screwing up the waterway for all of us that want to use it legally, as well as the court system to decide what is obvious. His problem(occupancy permit), is not our(sailors) problem.
