In my industry, 10% performance holdbacks are the norm. Unfortunately, a few manufactureres price their (lower quality) products with no expectation of ever getting the final 10%, so they just walk away from the responsibility, end up with the revenue they really wanted, no warranty responsibility and the customer thinks he saved 10% by letting them off the hook. Great idea for a new boat sale, but I would play that card after the final selling price has been agreed to.
