My son was aboard the Ava Claire (a 45' net boat) when it was run down by a freighter 30nm SE of Montauk on May 22, 2004. Fortunately, all 3 crew survived. Freighter came out of the fog doing 20+ knots, hit the Ava Claire in the wheel house, and cut it in two. Without a good paint match, the freighter put enough doubt into the minds of the jury that they were acquited. They took the defense that 'if we'd hit them, they'd be dead'. These tales, while infrequent, should not happen at all!
