Esentially its a public policy argument

It is in the public good for the State to have safety regulations for those that own or operate things that may be dangerous, but if the issuance of a license also allows the State to be sued every time an accident happens, then the State would soon lose interest in making any regulations at all. Recompense should in the first instance be against the owner operator, not the State.
