Sailboat owner claims mooring owner liable for vessel’s damage

Would you hold someone liable? I would have certainly insisted on a recent inspection before putting my 45 footer on a mooring for any length of time....why wait 4 years to file a lawsuit? There is more to this story I'm sure.

TENANTS HARBOR, Maine — A Massachusetts man has filed a lawsuit claiming that the people who rented him their home were negligent in not informing him that a mooring that went along with the property was defective, resulting in damage to his sailboat.

A lawsuit on behalf of Thomas Belknap Sr. of Wenham, Massachusetts, was filed Monday in Knox County Unified Court against Nickolas and Karen Dicke of Ennepetal, Germany. The Dickes own a home on the waterfront on Haskell Point Road in Tenants Harbor.

When Belknap rented the home from the Dickes in August 2011, he was told he could use the Dickes’ mooring for his 45-foot sailboat Evening Star, according to the lawsuit.

However, the mooring, which had not been registered with the town, had not been inspected and the chains broke during that week, the lawsuit states. As a result, the sailboat went adrift and grounded, causing substantial damage to the vessel, the suit adds.

Belknap, who is represented by attorney Edward MacColl of Portland, is seeking unspecified damages.

The Dickes could not be reached for comment.
