then you'll need to add stanchions on each side of the gap. That complicates the job and adds cost. It will be simpler if you cut the top rail near the stanchions and use a hinge one-side and catch on the other.

I wouldn't even cut the middle rail. It adds unity and strength to tie both sides as one overall structure, and is easily stepped-over. BTW that looks like a nice ladder.
