Billy is a great photographer. I haven't met him, but I've heard he's a class act.
The editors of SAIL are the ones who screwed up. Rule number one with handout photos that might be used for even a minor illustration - look at the IPTC field, see who shot the photo, contact the photographer, and ask if it is or has been used elsewhere. That rule is even more important when you are considering it for a cover shot. I'm sure Billy would have said that another mag is using it or considering using it. He would probably offer to do a SAIL specific shoot as well. Simple rules like that get ignored when magazines are too cheap to pay for photos.
