As the Pardey's note, the legal requirements for a durable power of attorney vary from state to state. For example, the sample they provide would not, if written today, be valid in Michigan and some other states. (If interested in what Michigan requires, click on link below.) I'm not saying one has to hire a lawyer to prepare a durable power of attorney. But doing it right is critical.
