The way most of these go is that the company will make a business decision to settle without admitting fault, because it will be cheaper for them than defending it. The Kaufmans won't have enough to buy a new boat because their attorney will get 1/3 of the settlement. That attorney will be the real winner, making enough money to buy some new equipment for his favorite little league team (that's an inside joke there 
).
